Archangels post is most succinct, except in one aspect; I cannot apply logic to morality.
The justice of killing someone in the defense of your family, or maybe your own defense, is unquestionable.
The question asked was regarding the legitimacy of the death penalty, legally, morally, religiousy or otherwise.
Several posts have discussed the deterent factor, and I would agree the deterent of behind closed doors execution is null and void. Public execution would seem a barbaric feast of voyeurism too.

My initial arguement stands though. Who amongst us has the wisdom or courage to order anothers demise without hiding behind the skirts of law, often very old law, written by detatched people in their ivory towers, be they politicians, priests, dictators or other?

Perhaps if the general populace were given a freer hand in the meting out of justice...Do not segregate sex offenders, peadophiles, rapists etc in jail. Their lot would be a very uncomfortable one. Do not tie a law officers hands in the doing of his duty, if any person who kills a public servant happens to suffer severe consequences at the hands of his/her captor, then boo-hoo, I for one would turn a blind eye.
As much as I try to think of a better way to express the sentiment, it is best summed up with the old cliche:- "what goes around comes around", and if you reflect upon the saying, I'm sure you will realise its truth.
