Actually Texas cannot legally secede any more than any other state can. There is a mechanism that has never been tested in the USSC/or any way else, for leaving the Union. The problem in 1860 was the method used by the southern states did not follow this process. If one doubts the legality of a Texas secession based on the misconception of how it was admitted please refer to the results of 1865 for further enlightentment.
I remind everyone ALL states are countries in their own right, that have merely handed over some power to a federal government. The fact that these same countries/states allow and permit the federal government to perform functions that are clearly beyond the powers the states and the people have granted them is a major part of the problem - but then you cannot ask state politicians who have eyes for national seats to do anything else now can you?
